Overview

With the recent launch of the GMRA legal opinion for Ghana, the ICMA West African region held a webinar providing practical guidance on the use of the GMRA for the benefit of African capital market professionals.

For those who have never used a master agreement before, the GMRA can come as a bit of shock. This session seeked to relieve that anxiety by mapping the stages in the life of a repo to the relevant clauses in the GMRA to show how the agreement can aid your business, not just by providing legal certainty but also by providing practical guidance on how to transact and manage repos. The mapping started with the establishment of a documented relationship with a counterparty using Annex I and agreement on key legal safeguards ahead of dealing, through the execution and settlement of a new transaction, then the management of transactions (eg confirmation, variation margining, substitution of collateral and coupon payments), finishing with procedures to handle problems such as failed delivery and counterparty default.
